These Terms of Service are effective as of June 4, 2026. By accessing or using westbocawaterheaters.com (the “Site”) or engaging West Boca Water Heaters (“we,” “us,” or “our”) for any service, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

Our Services

West Boca Water Heaters is a family-owned, owner-operated company and a licensed Florida master plumber. We provide water heater installation, repair, and replacement for both tank and tankless systems, as well as a range of plumbing services including drain cleaning, leak detection, sewer line services, slab leak detection and repair, toilet and fixture services, and garbage disposal installation and repair. We offer 24/7 emergency availability where operationally possible.

We serve Boca Raton, West Boca, Delray Beach, Boynton Beach, Coconut Creek, Highland Beach, and surrounding South Palm Beach County, Florida communities. Service availability in a specific location is subject to change. We reserve the right to decline, reschedule, or cancel any job at our discretion, including due to unsafe conditions, scope changes, or circumstances outside our reasonable control.

Estimates & Pricing

Any estimate, quote, or price range provided verbally or informally is preliminary and not binding. An estimate becomes binding only when provided to you in writing and authorized by you prior to work beginning. A diagnostic or service-call fee may apply for certain visits, particularly when a diagnostic assessment is required before work can be quoted.

Final pricing may differ from an initial estimate if unforeseen conditions, additional required work, or changes in materials or scope are discovered during the job. We will communicate any such changes and obtain your authorization before proceeding with work beyond what was originally agreed. By authorizing us to perform work, you agree to pay the agreed-upon or updated price upon completion.

Scheduling, Access & Cancellations

You agree to provide us with safe, timely, and reasonable access to the work area at the time of your scheduled appointment. This includes ensuring the area is free from hazards, that a responsible adult is present, and that relevant shutoffs or access points are accessible. Failure to provide adequate access may result in a service-call fee and rescheduling.

We offer 24/7 emergency availability where possible, but cannot guarantee specific arrival times for any appointment, including emergencies. Arrival windows are estimates only and may be affected by weather, traffic, prior job complexity, or other factors. If you need to cancel or reschedule, please contact us as early as possible. Cancellations made without reasonable notice may result in a trip or cancellation fee where applicable.

Payment Terms

Unless otherwise agreed in writing before work begins, payment is due in full upon completion of services. We will provide you with an invoice detailing the work performed and amounts due. We accept payment by commonly accepted methods, which may be confirmed at time of scheduling or service.

If a deposit is required for certain jobs (such as equipment orders or large installations), this will be communicated and agreed to in writing before work begins. You are responsible for any costs associated with returned, declined, or dishonored payments, including reasonable processing and collection fees. Unpaid balances may be subject to reasonable late charges and, if necessary, referral to a collections process in accordance with Florida law.

Warranties & Disclaimers

Workmanship

We stand behind the quality of our work. The applicable warranty period and specific terms for workmanship on any given job are provided with your written invoice or estimate. These terms may vary depending on the type and scope of work performed. Workmanship warranties cover defects directly resulting from our installation or repair work and do not extend to damage caused by factors outside our control.

Circumstances that may void a workmanship warranty include, but are not limited to: unauthorized modifications or alterations to the work by others; misuse, abuse, or neglect of the installed equipment or repaired system; failure to perform required maintenance; damage caused by third parties; or work performed on the same system by other contractors after our service.

Manufacturer Warranties

Equipment, parts, and materials we install may be covered by the manufacturer's warranty. Where applicable, we will pass through the manufacturer's warranty to you. Manufacturer warranties are separate from our workmanship warranty and are governed by the manufacturer's own terms and conditions. Product registration may be required to activate certain manufacturer warranties, and we encourage you to complete registration promptly after installation.

Disclaimer

To the fullest extent permitted by applicable Florida law, our services and the Site are provided on an “as is” and “as available” basis. We disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot be excluded under Florida law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the extent permitted by applicable Florida law, our total cumulative liability to you for any claim arising out of or related to our services or these Terms — whether in contract, tort, or otherwise — shall not exceed the total amount you paid us for the specific services giving rise to the claim.

In no event shall West Boca Water Heaters, its owners, employees, or agents be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to our services or your use of the Site, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you in full.

Indemnification

You agree to indemnify, defend, and hold harmless West Boca Water Heaters and its owners, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or our services; (b) your violation of these Terms; (c) your provision of inaccurate, incomplete, or misleading information that affects our ability to safely or properly perform services; or (d) damage to property or injury caused by conditions at the service location that were not disclosed to us prior to or during the service.

Communications Consent

By providing your contact information through the Site or directly to us, you consent to receive communications from us by phone, email, and text message (SMS/MMS) as described in our Privacy Policy. This includes service-related communications and, with your consent, marketing messages. You may opt out at any time as described in our Privacy Policy. Consent to marketing communications is not a condition of purchasing our services.

Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction in those courts.

Dispute Resolution

If an informal resolution cannot be reached, any dispute arising out of or related to these Terms or our services shall be subject to the governing law and venue provisions above. Nothing in this section limits either party's right to seek emergency or injunctive relief from a court of competent jurisdiction where appropriate.

Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the effective date at the top of this page. If changes are material, we may provide additional notice on the Site. Your continued use of the Site or engagement of our services after any updated Terms take effect constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

Severability & Entire Agreement

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity or enforceability of the remaining provisions. These Terms, together with our Privacy Policy and any written service agreement or estimate you have signed, constitute the entire agreement between you and West Boca Water Heaters with respect to the subject matter herein, and supersede all prior understandings, representations, or agreements whether written or oral.
